This Privacy Policy describes how H2Q Dance Company ("H2Q") manages Personal Data in accordance with Vietnamese law ("Law"). We encourage you to read this Privacy Policy to understand how we collect, use, and disclose your Personal Data.

1. Application of Privacy Policy

1.1 Personal Data means data, whether true or not, about an individual from which that person can be identified or whose identity can be reasonably ascertained from that data, or from that data and other information to which we have or are likely to have access, including any other meaning as may be ascribed to it under the Law as amended from time to time.
1.2 To collect your Personal Data as outlined below, you may be asked to provide us with basic information about you, including the following cate
gories of personal data ("Basic Personal Data"):Contact information (e.g., name, residential address, contact address, shipping address, postal or e-mail address, social media account/network, fax number and telephone number, payment information);
Product preferences, purchasing habits, purchase history, and spending behavior;
Other information related to you;
You may also voluntarily provide other personal data related to your inquiries or comments. However, to help us provide appropriate responses to you, we encourage you not to provide more personal data about you than is necessary.
Currently, we do not collect or process any of your sensitive personal information as classified under the Law, such as personal location data determined through location-based services ("Sensitive Personal Data"). If, in the future, there is a need to collect or process any of your Sensitive Personal Data to enhance your experience with us or to comply with legal requirements, we will notify you in advance and seek your valid consent (if necessary) before proceeding with the collection. Basic Personal Data and Sensitive Personal Data (if processed) are collectively referred to as "Personal Data".
1.3 By registering or using any product, service, or campaign provided by CMV, or by submitting information to or communicating with CMV, and by expressly agreeing through manipulating and performing certain steps on our platform as specifically instructed to you, this thereby constitutes your acknowledgment and consent to CMV and its affiliates, subsidiaries, and related companies (collectively and individually referred to as "the Companies"), as well as their respective representatives and/or authorized agents (collectively referred to as "Canon", "us", or "we"), to collect, use, and disclose your Personal Data in accordance with this Privacy Policy. "You" or "your" means any individual to whom the Law applies and includes any existing or potential individual customer, but excludes any organization, company (including corporate customers) and any other organization or body excluded under the Law.
1.4 This Privacy Policy and your use of this website shall be governed by the laws of Vietnam in all respects.

2. Data Collection and Consent

2.1 Your Personal Data may be collected from you in one or more of the following ways when:
you purchase tickets or products or services from us;
you post feedback or interact with our customer service representatives, for example, through meetings, emails, or phone calls (which may be recorded for training, quality control, business, and/or other legitimate purposes);
you request us to contact you, add you to an email list or other mailing list;
you respond to our promotions, campaigns, or other initiatives or attend our events;
you visit our websites;
you participate in any contests, surveys or promotions conducted by us and/or our business partners (including submitting photos);
we receive information about you from third-party social media services when you choose to connect to those services;
you provide or intend to provide confidential information to us in a transaction;
you submit your Personal Data to us for any other reason; and/or
we collect your Personal Data by other lawful means.
2.2 Unless permitted by law, we will not collect, use, or disclose your Personal Data without your consent. We will only collect, use, and disclose Personal Data for purposes that are necessary on a reasonable basis and are adequate to achieve that purpose, and only when you have given your consent.
2.3 You warrant and represent to us that (a) the Personal Data you disclose to us is accurate and complete; and (b) when you voluntarily provide Personal Data of another person to us, you are authorized by that person to disclose that person's Personal Data to us and that such Personal Data is accurate and complete.
2.4 Our Services are only for individuals aged 16 years and over. Anyone under 16 years of age may only access and use our Services with the explicit consent of a parent or legal guardian. If we discover that for any reason and by any means, personal data of a child under 16 years of age is submitted to us without proper consent, we have the right to delete and/or remove such data from our systems without prior notice to the person who provided the data. In addition, in such a case, we shall have no obligation to the data subject or the person who provided the data.
2.5 You are informed that we may collect and use your Personal Data without your consent in cases permitted by law.
2.6 If you decide to only partially consent, or to consent with conditions, to our collection and processing of your Personal Data, please follow the instructions provided on our website or through the relevant communication channels you are interacting with. If you need further assistance with this matter, you may submit a request to our Data Protection Officer at the email address provided in Article 12 of this Privacy Policy. We will respond to you on how we will handle and resolve your case. However, please note that, to maintain effective internal operations, we have the right to refuse to provide products/services or engage in transactions with you if we do not receive your full consent to process your data.

3. Purposes for Which We Collect, Use, and Disclose Your Personal Data

3.1 Your Personal Data may be collected, used, and/or disclosed for the following purposes:
To verify and process your personal and payment information.
To provide you with tickets and other products and services.
To respond to and resolve inquiries, complaints, and other customer service issues, or to contact you.
To send you information, promotions, updates, and marketing and advertising materials related to our goods and services.
To manage, develop, and improve our business operations and to serve you better.
To conduct promotions and marketing campaigns, contests and lucky draws, and to personalize your experience at our customer touchpoints.
To conduct market research and customer surveys.
To conduct investigations or audits or to carry out anti-fraud and risk management activities.
To comply with legal and regulatory requirements.
To exercise our legal rights and obligations.
For other purposes for which we have obtained your consent; and
For any other purpose that is reasonably necessary, ancillary, or related to the specific purposes listed above.
3.2 Your Personal Data may be disclosed for the purposes set out above to our employees, third parties, affiliates, service providers, consultants, including but not limited to the following persons or organizations:
Banks, credit card companies, and payment solution providers;
Shipping and delivery service providers;
Call center service providers;
Our business partners and authorized distributors, resellers, or agents;
Relevant government agencies or regulatory authorities or law enforcement agencies;
Our insurance and consulting companies, including consultants, auditors, and lawyers;
Data intermediaries; and
Any other party that you authorize us to disclose your Personal Data to.
Except for relevant government agencies and regulatory authorities or law enforcement agencies, we will ensure that the parties receiving your Personal Data (i) have a confidentiality obligation to us in relation to the use, holding, processing, storage, and/or transfer of your Personal Data; and (ii) have a need to know or process such Personal Data.
3.3 If you have provided us with your phone number(s) and indicated your consent to receive marketing or advertising information via such phone number(s), we may from time to time contact you via such phone number(s) (via voice calls, text messages, fax, or other means) to provide you with information about our products and services.
3.4 Similarly, we will only collect, use, and/or disclose your Personal Data for marketing purposes when we have obtained your consent to do so and only after you have been informed of the purposes for which we are doing so and the consequences of your consent to us.

4. Withdrawal of Consent and Access Rights

4.1 You may withdraw your consent to our continued use and disclosure of your Personal Data or obtain access to your Personal Data (to the extent permitted by law) at any time by writing to our Data Protection Officer. You may also withdraw your consent to the manner and means by which we contact you by opting out as indicated in our emails or other marketing communications.
4.2 If you withdraw your consent, you understand that we may not be able to provide or continue to provide certain goods and/or services to you and accordingly we may have to cease providing such goods and/or services without any legal liability. Please note that it may take up to 30 days for any withdrawal of consent request to be reflected in our systems.
4.3 Upon your request, within 30 days, we will endeavor to provide you with a copy of your Personal Data that we hold or control, or we will inform you of the time limit within which we will respond to your request. This information about your Personal Data will relate to how your Personal Data has been or may have been used or disclosed in the year preceding the date of your request. Thereafter, we will cease collecting and processing your Personal Data and accordingly will request that the relevant third parties, as mentioned in Clause 3.2 above, also cease collecting and processing your Personal Data.
4.4 We reserve the right to charge a reasonable fee to fulfill your request, if permitted by law.

5. Accuracy and Correction

5.1 We will endeavor to ensure that the Personal Data we use is accurate and complete enough for the purposes for which it is used.
5.2 To help us maintain the accuracy of your Personal Data, we encourage you to notify us of any changes to your Personal Data that you have provided to us by writing directly to our Data Protection Officer. Upon receipt of a request to correct your Personal Data, we will promptly update or complete the necessary changes. In the event that we are unable to make the corrections immediately, we will notify you within 72 hours of receiving your request.

6. Security, Policies, and Procedures

6.1 We will endeavor to protect your Personal Data that we hold or control from risks of unauthorized access, collection, use, disclosure, copying, modification, processing, or destruction through reasonable and appropriate security measures. We endeavor to ensure that our systems are secure and meet appropriate standards. To prevent unauthorized access and maintain data integrity and security, and to ensure the correct use of information, we have implemented appropriate physical and electronic safeguards to protect and secure the Personal Data we collect. You acknowledge that, notwithstanding the security measures we have in place to protect your Personal Data, no data transmission over the Internet can be guaranteed to be completely secure and by providing your Personal Data, you are assuming the risk of transmitting this information.
6.2 To comply with our legal obligations, we may be required to conduct data protection impact assessments in relation to the collection and processing of your Personal Data. These assessments will be prepared in accordance with the law and may need to be submitted to the relevant competent authorities as required by law. Our aim is to ensure compliance with the legal framework and to protect your privacy and safeguard your Personal Data as required by law.

7. Data Retention and Deletion

7.1 We will retain your Personal Data for the period during which you use our products or services and when it is necessary or relevant for business purposes or as required by law.
7.2 You have the right to request the deletion or removal of your Personal Data in circumstances permitted by law.
7.3 We will carefully consider the grounds for your request for data deletion and take appropriate steps, including technical measures, to address your request. Please note that we may not be able to immediately remove data from our backup systems due to applicable legal restrictions and/or technical limitations. In such cases, we will securely store your personal information and isolate it from any further processing until such time as the backup can be deleted or anonymized. However, we will make every effort to ensure that the requested personal information is completely deleted within 72 hours of receiving your deletion request, unless we are legally entitled to refuse to delete the data.
7.4 We will cease retention and will delete or anonymize your Personal Data after the purpose for which the data was collected has been fulfilled, or after we have agreed to your request for data deletion, or after we have ceased operating the relevant products or services.
7.5 Please note that if your Personal Data is deleted due to reasons such as the collection and processing of data no longer being necessary for our business operations or in the event that H2Q is dissolved, bankrupt, or ceases business operations as required by law, this data will be permanently deleted and cannot be retrieved after the data deletion process is complete.
7.6 However, the law may permit exceptions to the deletion of your Personal Data even if you have requested deletion. In such cases, we may retain this information for a longer period than the standard retention period, where permitted by law, even if further processing of the data is not directly related to the original purpose for which the data was collected.

8. Other Rights Regarding Your Personal Data

In addition to the other rights you have in relation to your Personal Data, you have the rights permitted by law, such as:
8.1 Right to Access Your Personal Data. You have the right to request a copy of the Personal Data we hold about you. Please note that if you wish to obtain personal data that we have collected from you and are currently processing, you need to contact our Data Protection Officer at the contact information provided in Clause 12 of this Privacy Policy, complete and sign the standard personal data request form provided by us. After you have completed and signed this form, please send it to the email address of our Data Protection Officer. We will only provide you with the requested data upon receipt of the fully completed and signed request form. This is to ensure that the provision of data upon request complies with legal requirements. If you are illiterate or disabled and cannot complete the request form, please contact our Data Protection Officer at the contact information provided in Clause 12 of this Privacy Policy so that we can assist you in completing the request form.

9. Processing Personal Data of Deceased or Missing Individuals

In the event that you are declared deceased or missing, we understand the importance of protecting your Personal Data. We understand the sensitive nature and privacy concerns surrounding such cases, and we are committed to maintaining the confidentiality of your information. Therefore, we will only continue to process your Personal Data upon receipt of written consent from your spouse, children over the age of 18, or your parents if the aforementioned individuals are not available.

10.1 We collect information about the activity on our website, such as the number of visitors, the pages they visit, and the duration of their visits. This information is collected on an aggregated, anonymous basis through the use of web server logs and cookies. This means that no Personal Data is linked to this collected data.
